Charges against John Rigas and his son for tax evasion and fraud will not be dismissed according to a federal judge.
The founder of Adelphia Communications Corp. and his son, Timothy, will face charges in New York, the judge ruled Friday.
Both John Rigas and Timothy Rigas, once Adelphia’s chief financial officer, are in prison and serving sentences for a number of corporate convictions: bank and bond fraud among them.
Tax evasion allowed the father and son to accumulate millions for their own use as they mishandled and defrauded in Pennsylvania in 2005. Prosecutors charge that the duo grabbed about $1.9 billion in Adelphia funds fraudulently.
The Rigases are trying to claim that their acquittal on wire fraud and conspiracy charges proves that they did not divert funds for their own use.
